ARTICLE I
Title of the Ordinance
Section 1. Title- This ordinance shall be known as the Bacnotan Comprehensive Educational Assistance Program and shall hereinafter referred to as the “BCEAP”.
ARTICLE II
Coverage
Section 2. Coverage- This ordinance shall apply to all applicants for scholarship in high school and college in both public and private educational institutions located in La Union who are bonafide residents of any of the forty seven (47) barangays of the Municipality of Bacnotan, La Union and could quality to the other requirements of the program hereinafter enumerated.
ARTICLE III
Purpose/Goals
Section 3. Rationale- This ordinance is enacted for the following purpose:
- To show the people the deep concern of the local government to parents in terms of educational needs of their children;
- To encourage students who feel discouraged in their financial conditions relative to pursuit for higher education to stay loyal to the government as the government’s purpose is to always look for the welfare of its constituents;
- To provide financial assistance to qualified and deserving students;
- To bring the government closer to the people; and
- To promote educated citizen in the community who shall represent the people in a more organized society leading to a more
ARTICLE IV
Definition of Terms
Section 4. Definitions of Terms- For the purposes of this ordinance, the following terms shall apply and defined as follows:
- BCEAP- it is the acronym of Bacnotan Comprehensive Educational Assistance Program.
- bonafide resident- as used in this ordinance , is the length of stay of a person in the barangay which is at least six (6) months from his/her arrival therein and henceforth.
- Board- it means the BCEAP Board composed of seven (7) persons defined in Article V, Section 3 appointed by the Municipal Mayor as Chairman who shall exercise the function of screening and selecting the student-applicants to be entitled to receive BCEAP benefits.
- co-terminous- is a tenure of office of the members of the committee which shall cease upon the termination of the office of the of the appointing power/authority
- educational assistance- is the financial allowance/benefit given by the local government unit of Bacnotan, La Union given to a grantee.
- Form 138- it is a document issued by school authorities particularly government schools in both the elementary and secondary level showing the grades of a pupil/students from the first grading period to the fourth grading period. It is commonly known to many as the Card.
- Form 137- it is a school document which shows the record of the pupil/student since he/she entered the Grade I up to his graduation in high school.
- graduate- a student who finished the required units in a particular level of education, i.e. elementary, secondary, etc.
- grantee- he/she is the student/applicant who, after passing the screening and selection process by the board, is entitled to enjoy benefits granted by the BCEAP.
- first year high school- shall also mean grade seven of the K-12 educational program of the Department of Education.
ARTICLE V
The BCEAP Board
Section 5. Creation – The BCEAP Board is hereby created and shall compose of the following:
- Chairperson – Chairperson of the Committee on Education and Culture of the Sangguniang Bayan
- Vice Chairperson- Vice Chairperson of the Committee on Education and Culture of the Sangguniang Bayan
- Three (3) members of the Com. On Education and Culture of the Sangguniang Bayan
- Municipal Social Welfare and Development Office
- Municipal Budget Officer
- District Supervisor or his/her authorized representative
- President or school head of any college in the municipality of Bacnotan to be appointed by the Municipal Mayor.
- Student representative from the high school to be recommended by their respective principal and to be appointed by the Mayor.
- Student representative from the college level to be recommended by their respective head of school and to be appointed by the Mayor.

Section 6. Powers, Duties and Functions of the BCEAP BOARD
- 6.1 The BCEAP Board shall receive endorsement of applications of BCEAP scholarship from the Office of the Municipal Mayor.
- 6.2 The BCEAP Board shall be the screening body and shall select and recommend to the Municipal Mayor applicants qualified to receive scholarship grants from the Local Government Unit of Bacnotan, La Union.
- 6.3 The BCEAP Board shall recommend to the Sagguniang Bayan amendents of the policies and guidelines of the BCEAP.
- 6.4 The BCEAP Board shall conduct interviews and other necessary methods to ensure the validity of the selection process.
ARTICLE VI
Qualification of Applicants
Section 7. Qualification. The following shall be observed as guidelines in the acceptance of applicants to the BCEAP:
- 7.1 An applicant must come from a family whose combined parent’s income cannot sufficiently sustain the education of the applicants for his chosen course.
- 7.2
- a. An applicant for high school scholarship must be a completer or graduate of any elementary school and incase where the applicant was not able to continue to enroll in high school immediately after his graduation in the elementary, such failure of not continuing shall not be more than three(3) years from his graduation. A certification from the school head/principal of the school he graduated specifying therein the year he graduated is a must. Aside from such certification, his/her Form 138 is required.
- b. An applicant for college scholarship must be a graduated of any high school and incase where the applicant was not able to continue to enroll in college immediately after his graduation in high school, such failure of not continuing shall not be more than three (3) years from his graduation. A certification from the school head/principal of the school he graduated specifying therein the year he graduated is a must. Aside from such certification, his/her Form 138 is required.
- 7.3 An applicant must have a general average of 85% as shown in his Form 138 or Form 137. Such DepEd Forms are required.
- 7.4 An applicant must be a Bonafide resident of the Municipality of Bacnotan, La Union for at least six(6) months prior to his application.
- 7.5 An applicant is willing to enroll in any high school in Bacnotan, La Union or any college school in La Union and must submit a copy of the result of entrance examination, if any, of that particular school.
- 7.6 An applicant must have no derogatory record in any barangay of the Municipality of Bacnotan or any school he attendsed, hence a barangay clearance and school head certificate and school head certification of good moral character respectively are required.
- 7.7 A background investigation report from the Municipality Social Welfare Department to establish subsections 7.1,7.4,7.6 and 7.7 of this section is required.
- 7.8 An applicant must be willing to submit himself/herself for an interview before the Board and must pass the same.
ARTICLE VII
Duties of the BCEAP Grantee
Section 8. Duties. The BCEAP grantee must perform the following:
- 8.1 A BCEAP college grantee shall always be enrolled in full load as prescribe by the institution/school and shall be able to obtain a general average of at least 80%, must have no failure or incomplete grade and no dropped subject;
- 8.2 A BCEAP college grantee shall finish the course wherein he/she was enrolled within the prescribe number of years otherwise, the BCEAP is not liable for the privilege/benefits being grantees in excess of such number of years.
- 8.3 A BCEAP grantee shall in maintain a good record in the school where he/she is enrolled and in the event he/she shall be subjected to disciplinary action by reason of violation of school rules and regulation and after due investigation and hearing later on found guilty of the of the offense charged, he/she ipso facto be dropped from the BCEAP rolls;
- 8.4 A BCEAP college grantee shall not be allowed to change neither shift to another course once he/she has enrolled.
- 8.5 In the event that a BCEAP grantee shall decide to discontinue his/her studies, for any reason, he/she shall notify the Board and the Municipal Mayor of such decision and in the event that the Board finds that such reason for discontinuance is not valid, grantee shall be required to reimburse all monetary benefits received by him/her from the BCEAP;
- 8.6 A BCEAP grantee shall at all times show his/her loyalty to the local government by supporting all projects and programs and in no case shall he/she support or adheres to activities that tend to undermine such government programs and project and in the event that is he/she found yielding to such indifferent acts and attitudes he/she ipso facto be dropped from the BCEAP rolls and required to reimburse all benefits he received from BCEAP.
- 8.7 A BCEAP qualifier, if he chooses to avail the BCEAP scholarship program, must drop any other scholarship grants he obtained from other sources. However, this provision does not apply to BCEAP college grantees for enrollment in private educational institutions.
ARTICLE VIII
Benefits Granted by BCEAP
Section 9. The following benefits are granted to BCEAP grantees;
- 9.1 A BCEAP high School grantee shall be entitled to an educational assistance in the form of stipend only in the amount of Six Thousand Pesos (P6,000.00) per school year.
- 9.2 A BCEAP college grantee in a state college or university shall be entitled to an educational assistance in the amount of Seven Thousand Pesos (P7,000.00) per semester.
- 9.3 A BCEAP college grantee in a private college or university whose chosen course is not offered in any state college and university in La Union shall be entitled to an education assistance in the form of stipend in the amount of Eight Thousand Pesos (P8,000.00) per semester.
- 9.4 If for valid reason a grantee has to take summer classes, he shall be entitled to Two Thousand Five Hundred Pesos (P2,500.00) educational assistance for the entire summer term.
- 9.5 BCEAP grantees are priorities in their employment under the SPES program of the government;
- 9.6 BCEAP grantees shall serve as trustee of the local government assist the SK and Barangay Officials in the barangay where he/she resides in the implementation of the programs and projects of the barangay;
ARTICLE IX
BCEAP ANNUAL BUDGET
Section 10. The BCEAP shall have an initial annual budget of SEVEN HUNDED TWENTY THOUSAND PESOS (P720,000.00), Philippines currency to be included in the other services/expenditures of the Municipal Mayor and shall be used exclusively for BCEAP grantees/benefits for School Year 2018-2019;
Section 11. The annual budget shall be increased in the event that more grantees shall be us accommodated in succeeding school years. Provided, however, that funds are available for the purpose.
ARTICLE X
Repealing Clause
Section 12. Any ordinance of the municipality or portion thereof which is inconsistent with the provision of this ordinance is deemed repealed or modified accordingly.
ARTICLE XI
Separation Clause
Section 13. If for any reason, any portion or provision of this ordinance is declared unconstitutional or invalid, the other portions or provisions thereof which are not affected shall continue to be in full force and effect.
ARTICLE XII
Effectivity
Section 14. This ordinance shall take effect immediately after its approval.
